The Legal Definition of Entrapment



The National Post is reporting that on Friday a judge ruled "the RCMP officer who stunned Robert Dziekanski with a Taser at Vancouver’s airport lied at a public inquiry.,, Const. Kwesi Millington’s perjury conviction comes more than seven years after Dziekanski’s fatal confrontation with police." CBC is reporting that the first time a judge has agreed with the prosecutors who argued that Millington and his fellow officers conspired to lie and exaggerate the threat Dziekanksi posed in order to justify their use of force. This ties in with the entrapment and exploitation of John Nuttall.

OK so we've talked about how dramatically the world has changed since 9/11 and how the Constitution and the Charter of Rights have been completely abandoned. We've talked about how in this new age of treason we call patriots traitors and traitors patriots. The next thing we have to discuss is the legal definition of entrapment and how massive amounts of tax dollars are being spent and misplaced on not saving the world from terrorists but on creating them. This is a concern the Rolling Stone magazine recently made very loud and clear.

On the first day of the John Nuttall trial the judge gave the jury specific instructions. She told them that they were not allowed to read my blog. She didn't refer to my blog specifically, she said any blog that discusses the case. She said their role was not investigations. It was not their job to investigate the case. It was their job to decide whether or not they feel the suspects are guilty beyond a reasonable doubt based solely on the evidence presented in court. She also their their job was not to interpret the law. Interpreting the law was her job and she would do it form them. If she errs in her interpretation of the law that would be grounds for an appeal. However, I think it's really important we objective examine just what the legal definition of entrapment really is because it appears to be completely ignored in our day of treason.

Wikipedia states "In criminal law, entrapment is a practice whereby a law enforcement agent induces a person to commit a criminal offense that the person would have otherwise been unlikely to commit. It is a type of conduct that is generally frowned upon, and thus in many jurisdictions is a possible defense against criminal liability."

In the John Nuttall case he clearly would not only have been unlikely to commit the crime he has been charged with he would have been unable to without the RCMP driving him around, telling him what to do and providing the explosives. It's not a matter of it being unlikely it is a matter of him being unable. That means this is a clear case of entrapment. What we need to discuss is the absurd amount of tax dollars that are being spent and misplaced on trying desperately to turn drug addicts into terrorists. That is not in the public interest.

Three Toronto cops charged with gang rape



In contrast this one is somewhat more disturbing. Three Toronto police officers have been charged with gang raping a female officer. The Toronto Sun is reporting that the three police officers, Joshua Cabero, Leslie Nyznik and Sameer Kara were swiftly freed on $15,000 bail

Rape is a heinous crime all on it's own. Gang rape is deranged. Yet three police officers gang raping a fellow officer is a colossal betrayal of trust. Sexual harassment is a huge problem within the RCMP that they refuse to address. That's why they are facing a class action lawsuit about it. As EAF has mentioned over 300 female officers are part of a class action lawsuit alleging sexual harassment in their workplace. That is huge.



I was under the impression that Catherine Galliford was leading that class action but I understand that is not true it is Janet Merlo who is leading it. Catherine Galliford's case is entirely separate. Catherine was the public face for the RCMP in the media during the Pickton case and Air India. I have no idea why they don't settle that one. I understand she is willing to agree to a gag order. If they don't settle there will be no gag order. It is clear they want to drag it on and punish her by burning tax dollars to cover their criminal negligence.

Janet Merlo wrote a book about her experiences called No One to Tell: Breaking My Silence on Life in the RCMP. The Globe and Mail reported that Janet paints a picture of near daily harassment. Some of the allegations are just stupid innuendos that are obviously not appropriate in any work force not to mention the RCMP. In any other industry the company would deal with it to fulfill their legal obligation instead of sweep it under the carpet and not only tolerate the inappropriate behavior but actually promote people who are intrenched in it.

Yet some of the allegations are much more serious and include actual rape. During the Winter Olympics in Vancouver members of the RCMP were accused of smuggling a stripper in a hockey duffel bag onto a cruise ship for security personal. During that drunken party a police officer was accused of raping a female coworker. That story was buried because whistle blowers are afraid of retaliation since they get slandered and attacked for reporting criminal activity. Not all the allegations are unproven. Don Ray was convicted and sent to Surrey. The fact that he is still employed with the RCMP is proof they refuse to recognize their legal obligation to remove sexual harassment from the workplace. Any other industry he would have been fired.

Abbotsford Police Department corruption probe is corrupt



CBC is reporting that 17 Abbotsford police officers investigated for alleged misconduct. It was on the front page of today's Vancouver Province. They reported that 17 members of Abbotsford Police Department under investigation for alleged corruption. However, that's not entirely true.

Police corruption means some are on the take and are helping drug dealers escape justice. That's not what this probe is about at all. This probe claims some police officers were over zealous in obtaining search warrants to bust drug dealers and gang members. That's something completely different. No doubt the Abbotsford PD is under fire because they are the only ones implementing the New York model. A real corruption probe would look into what police officers helped drug dealers and gang members escape justice.

A real corruption probe would examine why the RCMP scuttled Operation Phoenix and let Hal Porteous escape justice. A real corruption probe would examine why Richard Barszczewski scuttled the Western Wind bust where police seized 2 1/2 tons of cocaine for the BC Hells Angels. Neil Hall reported that David Giles also known as Skelator was implicated in that bust. A real corruption probe would investigate why Richard Barszczewski let David Giles escape justice. A real corruption probe would examine why CSIS provided the explosives for the Air India bombing. That's what a real corruption probe would do.

John Nuttall misrepresented in court



The Vancouver Province is reporting that John Nuttall was misrepresented in court again. In the surveillance video from the hotel room the RCMP agents took him to and forced him to come up with a plan John states “I hope they die, my father and my stepmonster,” to the agent. “That’s how you call your mother, stepmonster?” asks the officer. “Yes, I hate them,” replies Nuttall. “They used to abuse me all the time and beat me. They’d lock me in my room for a week at a time.”

Clearly he did not say he hates his mother. His mother and grandmother were in court supporting him and he was glad to see them. He was referring to his step mother and his biological father who his real mother claims was abusive. John's statement on wiretap would confirm that claim.

John and Amanda lived with John's 90 year old grandmother in that basement suit. She is a sweetheart and they are good people who shared their suit with his mother's mother until she moved out right before the bust because they were afraid some Mr Big terrorist was going to kill them. John's grandmother said John and Amanda were the perfect couple. They would never argued or fight. They always got along with each other.

The police agents took them to hotels in Squamish and Kelowna to pressure them to come up with a plan to impress Mr Big. All they did was do drugs, play video games. The police agent was mad and said we've spent a lot of money on you. Mr. Big isn't going to be happy. You guys have to come up with some kind of plan. That's when they made up some nonsense when they were stoned that they had absolutely no ability to carry out. They didn't even have a car to pick up the pressure cookers on the shopping list the police agent gave them. We still have to go over the legal definition of entrapment.

Second Anniversary of Janice Shore's Brutal Murder



Today is the second anniversary of Janice Shore's brutal murder. She was beaten into a coma on December 2nd 2012 and died two months later in hospital on February 18 2013. The Chris Mohan story was the reason I started my web site and blog but the Janice Shore story and the Gary Webb story are the reason I keep it going.

Selling drugs in clubs to people who can afford it is really none of my business. Giving crack to the homeless for free then beating the life out of them for payment is my business. That is what fuels the plastic fake ass gang banger wanna be that lives the materialistic world of self indulgence. It is blood money earned through predatory exploitation.

If you don't front the drugs, there are no drug debts. Decapitating Bob Roth for a drug debt and caving in Janice's head for a nominal drug debt is deranged. I had never met Janice before the assault. I visited her in the hospital when she was in a coma and saw the physical damage inflicted on her. It looked like someone caved in her jaw and temple with a hammer. My daughter had seen her around a few times pan handling. She confirmed what the many others said, that Janice was quiet, soft spoken and very polite. The ideal mark for a predatory drug dealer outside the Front Room. She was also sexually assaulted.

I spoke to one police officer who said they had no evidence that she was sexually assaulted. Yes you do I said. You have the testimony of the witnesses that found her body. I spoke to one witness a year later when the First Nation Elders set up a tee pee and a sacred fire in Janice's honour. He was still freaked out about it over a year later. He confirmed that her head was caved in as though someone had crushed it with a huge rock and that her underwear was down around her ankles. Another person who knew Janice confirmed her quiet polite manner and said if she was killed for a drug debt it couldn't have been a large one because she was a user not a dealer. The Janice Shore murder pretty much sums up my beef with the predatory drug dealers outside the Front Room that exploit the homeless in a brutal manner.

I told the story of an ugly fat white chick terrorizing the sex trade workers outside the Front Room when I was trying to find the site Janice was murdered to set up a memorial. I asked a few homeless people where Janice was murdered and a sex trade worker showed me. You could tell she wasn't from here. She didn't try and ask me for money after she showed me the site. The fat ugly white girl kept asking her where ya going? Her response was simply to get a life. Who's that she kept asking as if to say is that a trick? Where's my money give me some money.

Six months later a former sex trade worker from the area contacted me and said that sounded like Colleen, one of Larry Mizen's coaccused. She said that tree where Janice was dumped at is where the drug dealers there demand free service from the sex trade workers they sell crack to. Leaving her body there was a message for all the others. Which clearly shows the hypocrisy in Larry Mizen's murder. Larry Mizen worked for Len Peltier who is a Hells Angles associate. Yes the Red and White terminated Larry's contract when he got some bad press but they were well aware of what he was doing all along. He was collecting their money and they didn't care how he did it. That is my beef. Lenny the weasel is still in town and that needs to be addressed.

ISIS Strikes Again



So ISIS beheads 21 Egyptian Christians in Libya. Wait a minute? Didn't we just help those rebels overthrow Gaddafi? Maybe that wasn't such a bright thing to do. Just like invading Iraq based on a lie wasn't such a good idea because that act is what created ISIS in the first place.

Although there are huge questions about who's really behind ISIS, when push comes to shove, ISIS does not concern me. Everyone knows they are bad. Everyone knows they do not represent Islam. Jordon certainly didn't play games with them when they executed a Jordanian pilot instead of following through with a prisoner exchange. They immediately executed two of their prisoners. It is clear that ISIS does not follow the prophet Mohamed. Which makes their flag the epitome of hypocrisy. It's like Mossad putting a star of David stamp on a brick of cocaine. Do these clowns not fear the god they misrepresent? The extremism is surreal.

Nevertheless, despite the extremism of ISIS we cannot let these insane acts distract us from the loss of civil liberty in Canada. You cannot defend freedom by throwing it away. In the US we can't let it distract us from the flaming reality of Operation Fast and Furious. Where the CIA infiltrated the ATF resulting in arms being sold to the Mexican cartel and tons of cocaine being brought into the United States and likely Canada as payment. We cannot lose sight of that colossal crime.

Thirty years after Air India: Inquiry head 'comfortable' with new anti-terror act

This is somewhat ironic. The Ottawa Citizen is reporting that retired Supreme Court justice John Major told a Senate committee that Bill C-51 gives significant new powers to the Canadian Security Intelligence Service (CSIS). “Warrants are required from a judge in certain circumstances,” such as search-and-seizure and communications intercepts. “But I think it comes down to a certain amount of faith in our agencies not to abuse the authority. I’m not aware of incidents where they are. I am comfortable with what I see.” Are you kidding me?! John Major was the clown who headed the inquiry into the Air India bombing. He doesn't say too much about CBC exposing the fact that the RCMP claimed that CSIS had a handler that helped plan the Air India attack and provided the explosives. Now he tells us that we should throw away civil liberty in support of CSIS's new powers to break the Charter of Rights? That is insane.

In contrast, last year the Ottawa Citizen reported that "A panel of three former judges who led high-profile judicial inquiries that examined national security matters cautioned the federal government Wednesday not to rush to adopt new anti-terrorism laws based on this month’s fatal attacks on two soldiers in Canada." Back then "Retired Supreme Court of Canada justice John Major, who led an inquiry into the 1985 Air India crash, said the RCMP and CSIS have 'broad powers' that must be carefully assessed before Canadians can conclude whether more are needed, and cautioned against a rush to enact new powers that may be unjustified." Sad to see how quickly he sold out civil liberty. CSIS need to be charged in the Air India bombing.

The problem with doing away with civil liberty in these "anti terrorism" bills is because how easily they are misinterpreted. As soon as England passed a bill doing away with due process for terrorists, with one sweep of the pen they labeled anyone participating in the occupy protest a terrorist thus removing their right to a fair trial, a lawyer or the need to be charged with an offense before they could be arrested. In Canada, a 70 year old environmentalist had members of the anti terrorist unit show up at her home because she took a picture of the Kinder Morgan pipeline.

Lunar New Year



Speaking of cultural diversity, on a more positive note, this Thursday February 19th is the Lunar New Year. We used to refer to is as the Chinese New Year but all of Asia celebrate it not just China so now we refer to is as the Lunar New Year since the calender is based on the phases of the moon not the traditional Western calendar.

We made a passing reference to the absurdity of the claim that the Chinese in China shouldn't celebrate Western holidays like Christmas. My response is why not? We celebrate the Lunar New Year here because we are a multi cultural society. Diversity makes us strong. The parade is on Saturday the 22nd.

I'm really enjoying this TV series on Netflicks about two guys traveling called Departures. After their cross Canada trip they visited Jordon and the experienced Diwali in India. Here in Surrey we know Diwali and Vaisakhi. They found some strange traditions of cremating human bodies then dumping the ashes in the Ganges river. Yet they were very respectful about it and explained this isn't our home. These are their traditions and we have to respect them. I really like the series. I have a friend I met on a local mountain from Europe who recently visited the Taj Mahal in India then went mountain climbing in Nepal. Indeed there is so much to see out there that you simply can't find in a crack pipe or on an episode of Sons of Anarchy. Departures is way better than any of that.

Ontario Hells Angel dead - Update



Turns out a blog reader is correct and that Johnny Spezzano is dead. His real name is Giovanni Spezzano and died suddenly on Monday, January 26, 2015. I don't know the guy and I'm not going to trash him now that he's dead. He was a father, husband, brother and son and was predeceased by his brother Pino. It would be interesting to find out the cause of death.

The Ottawa Citizen reported that Giovanni was a former member of the Ottawa chapter of the Outlaws who pledged allegiance to Rock Machine only to defect a few months later to the Hells Angels. His career in biker gangs was fast-tracked after he formed a friendship with Paul (Sasquatch) Porter. Paul was a member of the Rock Machine but crossed over tho the Hells Angels with several others when Mom Boucher went to prison.

Update: A local source claims he committed suicide which is always a huge loss for family. The question is, why hasn't there been any mention of his death on HA support walls? Not a word about a fallen brother? Perhaps that has something to do with why he committed suicide.

Traveling the world from Montreal to Morocco



There are still lots of stories to catch up on but I just wanted to pause for another reality check. This time of year I usually post lots of pictures snowshoeing in the mountains but locally the season has been a waste of time. Next year will be better. However, it draws my mind to searching out other places and other peaks. I'm watching a really interesting TV series on Netflicks about two Canadians who take a year off to travel the world called Departures. It's even better than Rick Steve's Europe. This is an intro on youtube.

They start off renting an RV and driving across Canada as a right of passage so to speak. Then they go to Jordon and it is amazing. Hiking up waterfalls, camping in the desert, climbing Petra. That is one place I really would like to see. I did a lot of traveling when I was young and now that my kids are all grown up I think the time is right for me to embark on another journey.



I know everyone likes the dirty laundry and want to hear K trashing bikers who sell crack. Yeah there's dumb, yeah they need a life but there's only so many ways to say that. Sometimes you just have to walk away and show them a better life. Personally I'd like to return to Montreal. I went there out of High School and it was awesome. I'd like to visit Quebec city. The old city walls look like Jerusalem. I'd like to rent a bike and ride from Montreal to Quebec City then through New Brunswick and Nova Scotia to Halifax. That is how I'd like to begin my journey.

Jordon is definitely one place I'd like to explore. I'd also like to explore Morocco and visit an oasis in the Sahara dessert. Now that's what I'm talking about. In Jordon and Morocco they're both Muslim but they're not crazy ass jihadists, they're just down to earth good people. I remember seeing an episode of Rick Steve's Europe and how historically the Muslims from north Africa were very clean, educated and tolerant. It's important to travel and get educated so we aren't blinded by stereotypes. The TV series Departures on Netflicks is well worth watching. Peace.
