CTV is reporting that "The trial for the man accused of killing RCMP Const. Rick O’Brien during an exchange of gunfire at a Coquitlam condo is now underway in B.C. Supreme Court in New Westminster. Nicholas Bellemare, the defendant, was also shot that day."
"The court heard O’Brien and his Ridge Meadows RCMP colleagues were executing drug warrants at three different locations, all related to the same investigation, on Sept. 22, 2023. At the Coquitlam condo, O’Brien was the lead officer responsible for making entry into the 22nd floor unit with a battering ram.
"According to the Crown, after breaching the door he was shot almost immediately with a prohibited AR-15-style rifle. A second officer was also injured by gunfire, then a third officer shot Bellemare in the forearm."
"The Crown said the trial will hinge on three key questions: Did Bellemare know O’Brien was a police officer when he allegedly shot him? Did Bellemare intend to kill Const. O’Brien? And was Bellemare acting in self-defence?"
This is indeed tragic. He obviously was not acting in self defense. The question is, did he know it was the police or did he think it was a drug rip?
It is highly unusual for drug dealers to shoot the police given the laxed laws for drug trafficking. It brings us to the no knock search warrant. Did the police announce it was them or not? Sometimes people pretend to be the police in home invasions.
No knock search warrants are common and are very dangerous. A neighbour testified that "Through the peephole of his door, he saw police officers in the hallway, up to an hour before he heard around seven to 10 shots fired."
That's pretty strange and would definitely imply the suspect knew it was the police. Yet the woman a responding officer saw struggling with the suspect was a plain clothes police officer.
In a bizarre twist CTV reported that "The court heard the condo was rented by a man named Christopher Michael Brett Perry. According to the agreed statement of facts, Bellemare was just 15 years old when he met Perry online. Perry was then 38 years old—and the Crown said around that time, police investigated Perry for possible child luring in relation to his interactions with Bellemare. No charges came of that investigation."
It's just so tragic when you see these pictures of police officers killed in duty they look like such clean cut good people. A constant reminder that police officers do risk their lives for the public they are commissioned to protect.
November 1st CBC reported that "Fort St. John RCMP have arrested two suspects after an early morning arson and shooting at a local nightclub. Just before 6 a.m. on Friday, police responded to a suspicious fire at the New Frontier Bar and Nightclub on 100th Avenue. Fort St. John Fire Department had extinguished the fire, according to an RCMP press release."
"After processing the scene, police found evidence of arson and gunfire directed at the building.Later that morning, police arrested two suspects at a home in Taylor, B.C., a district about 15 kilometres southeast of Fort St. John. The two suspects are being held in custody pending the investigation. The pub was open for lunch later that day."
The Vancouver Sun is reporting that "A man was shot and killed at Metrotown in Burnaby on Wednesday evening. Article content According to the Burnaby RCMP, police were called to the Station Square entrance to the mega mall just after 6:30 p.m. with reports of gunshots being fired in the area."
“'When police arrived on scene, they located a male victim,' said police spokesman Cpl. Mike Kalanj. 'Despite life-saving efforts, the man did not survive.' Shortly after, officers located a vehicle on fire at the South Burnaby Lawn Bowling Club in Central Park, near Kingsway and Inman Avenue."
Just 40 days ago, Chris d’Entremont said his constituents were hurting under Mark Carney’s government & warned that another massive Liberal deficit would make things worse.
Today he turned his back on Canadians & betrayed them to advance his own personal ambitions.
The BBC is reporting that "A Conservative MP's decision to defect and join the Liberal party is "exceptionally valuable", Canadian Prime Minister Mark Carney said on Wednesday, as he looks ahead to passing his first federal budget." OMG.
"Chris d'Entremont from Nova Scotia crossed the floor on Tuesday shortly after Carney put forward his fiscal plan, inching the Liberal government closer to a majority. Speaking to reporters, d'Entremont said he left because he no longer felt represented by Conservative opposition leader Pierre Poilievre. He has also hinted that others may follow." AYFKM?
This is really sleazy. Right before the vote on the most fiscally irresponsible budget in Canadian history. "Just 40 days ago, Chris d’Entremont said his constituents were hurting under Mark Carney’s government & warned that another massive Liberal deficit would make things worse." So what changed his mind?
What do you think? He was solicited. They all do it. Remember Chuck Cadman? When he was an Independent MP the Conservatives tried to bribe him with an insurance policy when he was dying of cancer to get his vote to trigger a non confidence. That was shady. Likewise it's obvious that Chris d'Entremont was bought.
All this smoke and mirrors hype about needing two more votes to pass the record deficit budget. The NDP aren't going to vote against it. Neither are the Bloc. This is a sheer power grab for more dirty deeds on the way.
While we're here, look at how the fake news is maliciously misrepresenting the budget's record deficit twice of what Justin Trudeau forecasted. The National Post Reported that "The Liberals tabled a plan containing nearly $126 billion in new spending and $60 billion in savings, which they hope will convince at least one opposition party to prevent an early election." That is sheer Satanism. There's not going to be another election over this budget. The other parties support it.
Look at the wording. They said this budget represented $60 billion in savings. That is a defiant lie. Compared to what? Compared to what Carney wanted to spend? It is a record deficit that is twice what Justin Trudeau forecasted.
Speaking of deficits, the National Post is also reporting that "This is the second time in one year that the tabling of a major Liberal government financial document has been overshadowed by an MP’s resignation. In December 2024, the Trudeau government’s fall economic statement was eclipsed by then-Finance Minister Chrystia Freeland’s shocking stepping down."
Remember that last budget circus side show? That budget was also twice what Justin Trudeau forecasted. He was going to blame it on Chrystia Freeland and fire her so she would take the fall for his deficit. Just like he fired Bill Morneau so he could take the fall over the We charity scandal. It was Justin Trudeau's charity not Bill Morneau. Justin Trudeau's family benefited from it not Bill Morneau's family.
So now, Chrystia Freeland's double deficit was a big deal but now all of a sudden Mark Carney's double deficit of that isn't? And this Clown who crossed the floor has the audacity to pretend he did it for Canada? That is ridiculous.
It was a dirty deal done dirt cheap. Having said that, I will address one of his rationalizations that does have merit. He mentioned Pierre Poilievre's negative style. That concern has merit. Canadians don't like American style negative advertising and Pierre Poilievre is full of it. He's so negative he's almost anti Canadian. I shall explain.
All Pierre Poilievre does is complain. He criticizes every word that comes out of Mark Carney's mouth. He refuses to agree with Mark Carney on anything. Every word that comes out of Pierre Poilievre's mouth is an opportunity to trash Carney and promote himself. He has the audacity to blame Carney for Trump's tariffs. At the same time he kisses trump's a*s. That is straight up dysfunctional.
Dough Ford was all about counter tariffs. Carney said no, now is the time to negotiate not for counter tariffs. He's right. Counter tariffs are going to piss off the ego maniac and counter tariffs are taxes. Then Ford runs an Ad on American Television quoting Reagan saying that tariffs are taxes. They are. So are counter tariffs ya dumb f*ck. Mark Carney's restraint in not launching counter tariffs was a good thing. Pierre Poilievre refuses to recognize that because he's so negative he's toxic.
Recently I mentioned that I created a new website at judicialtreason.ca after the Supreme Court of Canada shredded the Canadian Charter of Rights by denying Law students from Trinity Western legal accreditation. I let it expire after Trinity Western were forced to get rid of their morality pledge.
Well the Cowichan decision has caused me to re-register the domain and bring Judicial Treason back to spotlight judicial accountability in Canada. Peter Leask was a clown. Denying Trinity Western Law students accreditation was disgusting. Now the Cowichan decision is sheer treason. Bad judges need to be removed from the bench. They need to be fired.
TMZ is reporting that "A suspect in Toronto over the weekend had a pretty rough arrest ... 'cause he was accidentally run over by the same cop car, TWICE. Here's the deal ... viral video shows police officers firing a Taser at a man in a parking lot, and he freezes up and falls to the ground. While cops rush over to cuff him, an officer in a cruiser behind them jumps out -- but apparently forgets to put the vehicle in park, as it rolls forward over the suspect's legs and hitting the officer on top of him." That video is disgusting. They look like clowns in a circus.
CTV is reporting that "This year’s federal budget contains a deficit nearly twice the size forecast by the Liberals a year ago, as Prime Minister Mark Carney’s government prioritizes capital project spending over programs and services. The budget tabled Tuesday projects a $78.3-billion total deficit — the amount of money spent by the government beyond its revenues — for this fiscal year."
Everyone has strengths and weakness but Mark Carney's spending is treason. Mark Carney's spending is an attack on Canadian sovereignty. It is unsustainable.
The Dirty News is reporting that "Mathieu Pelletier, an HAMC member of the Quebec City chapter was arrested at Pearson Airport on the 28th of October. This comes after a warrant was issued four days earlier for his arrest. Pelletier is charged with the December 2024 murder of Jennifer Morin. She was Jeffrey Morin's mother. Jeff was BFM.
If the unions succeed in overthrowing the UCP government, the NDP will suffer the greatest political defeat in modern Alberta history. We, the Alberta Independence Movement, will ensure it.
Global is reporting that "A second member of the Alberta legislature is facing a citizen petition to recall her from her job. Alberta’s chief electoral officer Gordon McClure, speaking Monday to a legislature committee, said a recall campaign has been approved for United Conservative member Angela Pitt."
I've been seeing some strange posts about Alberta on X. One made reference to Unions overthrowing the UCP government. I was wondering what on earth they're talking about. I assume it's the recall petitions because Global is also reporting that "After a recall campaign for Alberta Minister of Education and Childcare Demetrios Nicolaides was approved by Elections Alberta, groups are planning on submitting requests to recall nearly every sitting UCP MLA across the province."
I started to see some others before that which reflected a very polarized view of Alberta politics. Far left versus far right. I saw one post that said rural Alberta wants protection from urban Alberta because Edmonton and Calgary don't have the same values they do. The Union complaint appears to reflect the Teachers who are upset about being legislated back to work.
As I previously said, the government of Alberta has every right to deem teachers essential services and legislate them back to work. My concern was the constant use of the notwithstanding clause which basically throws away the Charter of Rights like Justin Trudeau's erroneous use of the Emergency act.
I'm not going to jump to support Alberta teachers here because they seem to be part of the problem. They face the same polarized child exploitation BC does. Political extremists who want to sexualize young children and brainwash them with their political ideology. Prior to Jason Kenney, Alberta elected an NDP government. Jason Kenney turned out to be a Neo Con so there appears to be good and bad on both sides of the conflict.
Far left and far right stomping their feet and yelling at each other. What a mess. Like the deep polarization of the US where both sides actively strive to cancer and censor each other.
I'm not saying BC is any better because it's not. David Eby is a freak. John Horgan was a good man but we saw his policies change during Covid when he went from a minority government to a majority government. As soon as he got more power he started to crack down on rights and freedoms. David Eby's reckless spending is still a huge concern.
The Neo Cons highjacking MAGA in the US are a big concern. Kind of like Dough Ford and Tim Houston. Those two maniacs are not conservatives. This is what I keep saying about blind obedience to one side. Both extremes lead to the same place. That's why we need to be aware of and shun either extreme.
Pierre Poilievre supporting Stephen Harper's Neo Con is a bad thing. Just like Pierre Poilievre's blind support for a globalist like Netanyahu is. Pierre Poilievre publicly denouncing public sector workers isn't going to get him elected. That's why he lost in Ottawa. Public sector workers didn't want to lose their jobs.
One thing that Stephen Harper did right was get rid of the long gun registry. All this extremism concerns me because it means we won't be able to get our guns back. The last order in council the Liberals took away without a vote.
So once again we have come full circle. When I started this blog there was an activist in Aldergrove named Vern who launched a campaign of T-Shirts and Billboards aimed at supporting Judicial accountability. You've seen his work if you have driven on the 401 freeway from Abbotsford to Langley. He put that billboard up with permission from the land owner.
His signs and shirt started off with Judges are the Problem. Then it was 100% Contempt for BC Judges. After that he tried to be a bit more tactful and said Revolving Door Makes Judges Accomplices. He launched his campaign out of frustration over repeat offenders of property theft.
The more crimes these repeat offender would commit, the less jail time they would serve. It was completely backwards. The criminal code didn't say to do that. This was something the judges just started doing of their own accord. Hence the conclusion Judges are the Problem. He was absolutely right.
That judge needs to be fired and send to jail. When I started my blog, Peter Leask was being a maniac. After taking a historic tour of the parliament buildings in Victoria I said we've gone from the hanging judge to judges that should be hanged.
Neil Hall put that picture in his book The Hells Angels and the Million dollar Rat saying how I objected to some of Peter Leask's decisions. Rightfully so.
Judges still have no public accountability in Canada and that needs to change. It has made them defiantly arrogant and completely out of touch with public safety and natural justice.
We see some pretty bizarre solutions to this manufactured emergency. Danielle Smith is handing out notwithstanding clauses like smarties which basically says let's throw away the Charter of Rights. That is why Stepehen Harper supports it.
When I first started this blog Ed Schellengeburg's brother in law felt so strongly about judicial corruption in Canada he wanted me to make a separate website about it at High Treason dot com. I thought it was a good idea but I was already running so many different websites I didn't want to register yet another domain name so I created the judges Hall of Shame instead.
I kept it going for several years until Trinity Western cut a deal and got rid of their morality oath. That whole thing was shameful. People are allowed to have their religious beliefs. What the court did was obscene. I let that domain expire but we need to remember how bad the judges are in Canada and why they need to be accountable to the public who pay their wages.
My Kootney Now is reporting that "A B.C. Supreme Court judge has thrown out key evidence in a Castlegar drug trafficking case, ruling that police violated the accused’s Charter rights when a search warrant was executed in 2021."
"Justice Lindsay Lyster ruled that the RCMP officer who obtained the warrant for Andrew Lee Cancela’s home in April 2021 misled the judge who issued it by exaggerating evidence and failing to disclose critical facts."That is simply not true.
This case reinforces the fact that Judges are the problem. The police officer obtained a search warrant. It was not a warrantless search. The Supreme court Judge claimed the police officer misled the judge granting the search warrant because he didn't collaborate the informant's information. GMAFB.
The guy had a criminal record. The cop had an informant that said the guy was in possession of drugs at that time. That's what he told the judge and the judge granted the search warrant. Guess what. They were right. He did have drugs on his possession at the time. This judge has lost her mind.
"While Cancela still faces charges that carry potential life sentences, Lyster found that admitting improperly obtained evidence would cause greater harm to the justice system than allowing the case to collapse." AYFKM?
The cop obtained a search warrant. He did what he was supposed to do. This chick's a freak. The informant claimed that the suspect was the biggest cocaine dealer in Castlegar. The judge canceled the search warrant because the cop didn't verify that information. For F*ck's sakes. He had reasonable suspicion for a search warrant. The purpose of the search warrant was to verify the claim which it did.
This chick is either a freak, or she's on the take. Either way she needs to be removed from the bench. That is the problem. Canadian Judges have no accountability.
In the US judges are elected. In Canada they are not. Once they are appointed they are basically untouchable. It is very difficult if not impossible to get rid of a bad judge. Case in point Peter Leask. We had to wait until that clown retired before we finally got rid of him. That was shameful.
So is Lindsay Lyster on the take or is she just an arrogant sob with no regard for the Charter of Rights or public safety. None of the judges protected the Charter of Rights during Covid. They failed their single task - to safeguard the Charter. Now they are abusing the Charter to destroy public safety. She needs to be fired. That's all there is to it and she is not the only one.
The Calgary Herald is reporting that "The day after the UCP hit teachers with the notwithstanding clause, they used their power again — to clarify rules on big gifts for top government staffers."
CBA Alberta is reporting that "The Alberta government has invoked the notwithstanding clause to order teachers back to work. The Back to School Act imposes a collective agreement on teachers and prohibits them from striking until August 31, 2028."
OK I understand that teachers in Alberta are well paid and I also understand the Teachers strike in Alberta was well supported. Without commenting on the merits of the strike, I will express my concern about the use of the Notwithstanding clause. This isn't the first time Daniel Smith has threatened to use it.
The Notwithstanding clause is a very dangerous tool that can easily be abused. The US Constitution doesn't have one. It basically says Canadians have these rights notwithstanding certain circumstances. Justin Trudeau suspended Charter of Rights by erroneously declaring a state of Emergency. It's basically the same thing. It's a very bad precedent.
Back in the day, Canada Post was repeatedly declared an essential service and the federal government would legislate Postal workers back to work during a strike.
Alberta has the right to legislate teachers back to work but waving the Notwithstanding clause around the way they are is very dangerous and a complete contradiction for a party that claims to support civil liberty.
Recently the Supreme Court struck down a law implementing a one year mandatory minimum sentence for child pornography. They've done this before about minimum sentences. Committing crime is not a Charter Right. Bad judges need to be replaced.
Danielle Smith and Pierre Poilievre are jumping at the opportunity to use the notwithstanding clause to override the Supreme court on Child Porn minimum sentences. That's concerning because this is a manufactured emergency with a preplanned solution. They are eager to find an excuse to suspend the Charter of Rights. That's concerning.
Putting Harper in charge of the Alberta Pension was a huge mistake. Danielle Smith publicly endorsing a Neo Con is a very bad thing. The Kingdom of Saudi Arabia doesn't have a Charter of Rights. Trump sold out domestic production of oil so his son in law could get $5 billion for his hedge fund from Saudi.
David Myles the musician was born in Fredericton, New Brunswick. He was elected as the member of Parliament (MP) for Fredericton - Oromocto in the 2025 Canadian federal election. For real. That's awesome.
So I check his political affiliation - Liberal. That's OK. People are allowed to have different opinions. He probably joined in on the anti Trump takeover of Canada nonsense. Trump wrecked it for all of us. Now we just have to rein in Mark Carney's spending and his WEF obsession to ban all gas cars and motorcycles.
Keeping Canada sovereign is good. Surrendering that sovereignty to the WEF is not. Anyways. Hat's off to David Myles yo. My father's mother was born in Woodstock.
The LA Dodgers beat the Toronto Blue Jays in the final game of the world series last night. Hats off to both teams for a job well done. OK so the Blue Jays lost the first two games to the Seattle Mariners and came back to win it.
This series was right down to the wire. Toronto has a very good baseball team and basketball team. Vancouver doesn't. We loved the Grizzlies even though they never won.
Doug Ford is an idiot. I don't have a problem with Doug Ford's tariff adds but running them during the World Series was in bad taste. It was also one great big contradiction. Doug Ford kept cheering on counter tariffs which are taxes but Mark Carney said no, now is the time to negotiate.
Carney was right. Tariffs are taxes. Implementing Counter Tariffs is raising taxes. Then Ford turns around and runs an add saying Tariffs are taxes. Yeah they are. So are counter tariffs ya dumb f*ck. Doug Ford is an idiot who is BFFs with Chrystia Freeland. Clowns of a feather, spend tax payer's money together.
Speak of the Devil, in September CBC reported that "Longtime Liberal minister Chrystia Freeland is stepping down from cabinet and has signalled her plans to leave federal politics."
Oh Happy Day. Politico explains "Chrystia Freeland is leaving Mark Carney’s Cabinet to become a special envoy to Ukraine." GMAFB. Her grandfather was a literal Nazi. Canada deserves a better representative than that. Good Riddance.
Lotus Land is reporting that "Eby's reversal on decriminalization signals a new stage in BC's toxic drug crisis. The broad consensus on harm reduction has hit a wall with a public demand for more far-reaching answers to addiction, treatment, and effective enforcement."
"Premier David Eby’s dramatic appeal to Ottawa to amend BC’s decriminalization program to ban drug use in public spaces marks a turning point in the province’s eight-year-old battle with the fentanyl-driven overdose crisis. BC’s generation-long focus on harm reduction has hit a wall as fentanyl produces a wave of open drug use, hundreds of homeless, ill …"
OK so let's talk about how Harm Reduction has become Harm Promotion. John Horgan was a good man. So was Larry Campbell. Larry Campbell became the mayor of Vancouver and was compared to the TV series Da Vinci's inquest as he was also a corner who became mayor.
Larry Campbell was rightfully concerned with all the fatal drug overdoses. We all are. We differ on the most effective solution.
After that failed we opened more and more safe injections sites and turned the name to safe consumption sites which made addiction and drug overdose fatalities skyrocket.
That's when they joined Portland and came up with Decriminalization which instantly failed. It made public drug use skyrocket and public safety was at risk. So they said OK that didn't work and got rid of it yet they continue with all the well meaning insanity that got us here.
The Four Pillar program has four pillars not one. Enforcement, prevention and treatment are pivotal pillars in that program. The Portugal model succeeded because they made treatment mandatory. The political extremists failed to mention that part.
They didn't want to reduce addition they wanted to promote addiction by making it more socially acceptable.
Safe supply is a doctrine of the Devil because there's no such thing as a safe supply of harmful drugs. The primary point behind prevention is to educate the public by reinforcing the fact that harmful drugs are bad for you and you shouldn't do them. We lost that when we adapted the safe supply lie.
We abandoned the prevention pillar when we started calling lethal injection sites safe injections sites. We abandoned the prevention pillar when we sent out nurses in the DTES to show people how to use drugs safely. There's no safe way to use harmful drugs. Harmful drugs are harmful.
So just like with the failed decriminalization experiment we can all see that everything we have been doing to reduce drug fatalities has had the opposite effect. It's increased addiction and increased fatal overdoses.
As inspector John McKay pointed out, another reason the safe injection sites increased addiction and overdose fatalities is because the police created a buffer zone around the injection site where they stopped enforcing the law. Another abandonment of one of the critical four pillars - Enforcement.
Not only did they stop arresting people for using harmful drugs in public outside the safe injection sites, but they also stopped arresting drug dealers selling drugs outside the safe injection sites. The purpose of decriminalization was to arrest the drug dealers not the drug addict. Something they also failed to do.
So now Ken Sims is encouraging the VPD to arrest drug dealers in the DTES and the deranged extremists complain about a police state. Enforcing the law is one of the four pillars. Refusing to do that abandons the program and supports lawlessness - anarchy. That's what the extremists want. They want to be able to sell drugs and sell stolen goods without law enforcement stopping them. If you do that, addiction and fatalities spread like a forest fire which is exactly what we have seen.
When harm promotion failed, they said let's have a safe injection site. When fatal overdoses increased they said we need more safe injection sites. When drug overdoses continued to increase they say we need a safe supply. That is Satanic.
Not only is there no such thing as a safe supply of harmful drugs but providing free drugs to the public will instantly bankrupt our precious health care system. You can't get a MRI or cancer meds but you can get free heroin. That is how good intentions become defiantly evil at the snap of a finger. Oh snap.
Fatalities, violent crime, exploitation and human trafficking
We all see the increase addiction and fatal drug overdoses. The fake news uses those stats to emotionally blackmail us into doing bad things to help reduce the fatalities which only makes it worse. We all see the drug overdose deaths like the corner did in Da Vinci's inquest. Yet there's something else we don't see and that's everything else that goes with it.
I also liked Joel Thomas Hynes. He wasn't a big guy but he was real. As the Witcher fans would say he was authentic. I saw a picture of him in a leather jacket with a biker patch that said Preacher and said that's him. That's the guy.
I didn't want it to be about me. I wanted it to be about a list of people the Hells Angels in BC had killed including Janice Shore. A&E has since done a series about Margo Compton. I was blogging about her for years before that.
It never went anywhere so I registered the name and posted the first season on a website. If you scroll down to the bottom you'll see the first 13 names of people it would have covered.
It started off with Chris Mohan and Ed Schellenberg from the Surrey Six because that's why I started the blog. Then the Janice Shore murder really moved me. I wanted people to hear her story because that's what I mean about all the other bad things that goes along with the fatal drug overdoses. The brutal exploitation and the human trafficking. Just like Dianne Rock.
I wanted the theme song to be Dante's Prayer by Canadian Harpist Loreena Mckennitt. She wrote that moving song while reading Dante's Inferno on a train going across Siberia. Her jazz vocals lamentaded the grief and suffering she felt and observed. There's a line in the song that says remember me. I didn't want them to remember me I wanted them to remember the people who were killed and why. Remember them.
I didn't want an American company to do it because they'd probably screw it up like Hollywood or Netflix. I wanted CBC to do it. Like I said it never went anywhere so here we are. The whole point is to talk about everything else that goes along with the drug overdose fatalities. The brutal exploitation which includes human trafficking. Let's talk about that.
CBC is reporting that "In a news release, the Musqueam First Nation says that Chief and Council are deeply offended by the recent Supreme Court of British Columbia decision on Cowichan Tribes v Canada. Leadership and our entire community fundamentally disagree with the court's decision."
That's because this is one of many overlapping applications. The Musqueam nation is in Vancouver beside several other Tribes. The Cowichan nation is named after the Cowichan valley on Vancouver Island. The reason why land claims are often problematic is because several different tribes claim the same land. As a result there are more outstanding land claims then their is land in BC. That means we're going to have to share.
This illustrates another problem. As soon as the crown makes an agreement with a larger tribe a smaller tribe objects to it.
The Vancouver Sun is reporting that "The question that dominated a Richmond public meeting this week on the impact of a recent court decision on Aboriginal title was a simple one: Why weren’t we told sooner?”
"It was the province that first asked the court, back in 2017, to require notification. The court rejected the application, saying at that stage that no remedy from the court would impact the private landowners." Oh really?
"Case management judge J.A. Power of the B.C. Supreme Court rejected motions for notification from the provincial and federal governments. Article content The judge worried that if the court ordered formal notifications to private landowners it could be swamped with applications from them for standing." Of course it would. It's their land. They have standing. They have a right to submit opposition to the application.
Power ruled that “It would for all practical purposes put a halt to these proceedings.” So it should. Proceeding without them was unlawful. "Note: At this stage. In the event Cowichan were to revise its intentions in future, the private landowners could then proceed to court and file a complaint that they were not given formal notice earlier. Of course they can. They can do that now.
"The judge also recorded that the Cowichan Tribes had vigorously opposed the application to give formal notice to landowners because the Cowichan were not, at that time, seeking possession of the private fee-simple land."
This would support the Cowichan lawyers recent claim that no one was seeking to kick private owners off their property. They were seeking a different remedy. They want more money. A smaller tribe from a different area wants more money. Again. This is why not all overlapping applications are valid.
The province and John Rustad both oppose this decision.
Do you own your home? Are your private property rights at risk? This is a valid question thanks to David Eby’s NDP who directed the crown not to argue extinguishment of indigenous rights to protect private property rights.
