ABC is reporting that "The Supreme Court on Thursday set new limits on affirmative action programs in cases involving whether public and private colleges and universities can continue to use race as one factor among many in student admissions.
The court held, in an opinion for the conservative majority written by Chief Justice John Roberts, that Harvard and UNC's admissions programs violate the equal protection clause of the Fourteenth Amendment."
This is a copy of the ruling that resulted from a petition to the court submitted by
Students for Fair Admissions Inc. It's really not a controversial decision. What's controversial is admitting students based on race. That is a violation of the constitution. All people are equal.
Unfortunately this ruling only applies to Affirmative Action in College Admissions. They are going to make every other situation, hiring etc. make that long traipse through the court system as well. That takes time. Nothing stopped them from stating that AA was wrong period for any application. They chose to limit the scope. "Lawyers".
ReplyDeleteIt's a step forward. That's all the application asked for. If you want to add other jurisdictions, you need to make another application asking for that.
DeleteIt is indeed. The Left is losing their shit already. They asked for only that remedy, because to ask for "the full monty" risks it all being refused because they are uncomfortable undoing all of it at once, even if they know it's the right thing to do. At the same time, only a brief reading of SCOTUS and other such decisions in US courts will show that often a Judge will specifically state that this applies to other aspects. It's really up to the Judge, or in this case Judges plural, to use their discretion in such things. At least they are not bound by precedent the way our Judges volunteer to be. They have precedent as well of course. Just not always bound by it. Incorrect previous rulings need correction.

Colleges and Universities in both our countries were subverted long ago to the cause of anti Western Civilization Marxist and Globalist indoctrination and worse, this is nothing less than a stake through the heart of their attempts to use race to divide people against each other. The rest will follow.
